TERMS AND CONDITIONS OF SALE

These terms and conditions are intended to define the sales relationship between "the seller," the company "IVARENE," and "the customer" via the website ivarenegems.com, covering everything from ordering to services, payment, and delivery. They govern all steps required to place an order and ensure follow-up between the contracting parties.

APPLICABILITY OF TERMS AND CONDITIONS

All orders placed on the website ivarenegems.com are subject to these general terms and conditions, the acceptance of which is a determining factor without which the seller would not have entered into the contract. Placing an order requires and constitutes express and unconditional acceptance of these terms and conditions, which the customer has read prior to ordering on ivarenegems.com where they are directly accessible. The seller reserves the right to modify these terms and conditions at any time, in which case the applicable conditions will be those in force at the date of the order (Paris time — France).

The fact that the seller does not invoke any of the provisions of these terms and conditions at a given time shall not be construed as a waiver of the right to invoke them at a later date.

PRODUCTS

We wish to inform our customers that the images used to illustrate our products may differ slightly from reality due to display settings specific to each screen and lighting conditions during photography. Furthermore, given the handcrafted nature of our creations, variations in finish, size, and/or stone colour may occur, which is inherent to this method of production and cannot be considered defects. Our company's liability cannot be engaged on this basis, and this does not affect the validity of the order in any way.

Please note that photographs, graphic elements, and product descriptions presented for sale are purely indicative and are not contractually binding on our company.

ORDER

The customer declares that they have read and accepted these general terms and conditions of sale prior to placing their order. The customer's validation therefore constitutes acceptance of these terms and conditions.

After reviewing the contents of their order, the customer will confirm it definitively at the payment stage. This confirmation constitutes conclusion of the contract.

Once the contract is concluded, the company will send the customer, by email, a summary of the information entered on the order form. The order invoice will also be attached to the email sent to the customer.

Delivery will take place within a maximum period of 30 days.

The contract with ivarenegems.com is available in several languages. In the event of any difficulty of understanding or conflict between texts, the French version shall prevail over all other versions.

PRICING

Our product prices are listed in euros, inclusive of all taxes (VAT and other taxes applicable on the day of the order, unless otherwise stated, and excluding shipping costs). All orders, regardless of their origin, are payable in euros. When ordering from a country other than France, the customer unconditionally becomes the importer of the product(s) concerned. Any customs duties, local taxes, import duties, or state taxes that may be applicable are the sole responsibility of the customer and are not the seller's responsibility. IVARENE reserves the right to modify its prices at any time; the product will be invoiced at the rate in force at the time the order is confirmed and subject to availability.

PAYMENT

Validation of the order, which seals the contract, obliges the customer to pay, prior to dispatch, the full price of the item(s) ordered including applicable charges (VAT, shipping, etc.). Purchases are settled via Stripe, PayPal, or Alma. The customer's card number data is encrypted from their computer and transmitted in encrypted form directly to the banking operator, which decrypts it and manages payment authorisations. The seller reserves the right to refuse any order or delivery in the event of total or partial non-payment, a declined card payment, an existing or prior dispute with the customer, or for other reasons that IVARENE reserves the right to explain to the customer. IVARENE's liability cannot be engaged on this basis.

RIGHT OF WITHDRAWAL

In accordance with Articles L221-18 and following of the French Consumer Code, the customer has 14 days to withdraw from their purchase without having to provide any reason. The 14-day period begins on the day the customer receives the ordered item. To exercise their right of withdrawal, the customer will find the standard withdrawal form annexed to these terms and conditions, to be downloaded and sent to: IVARENE, 68 rue Singer, 75016, Paris, or by email to hello@ivarenegems.com along with a copy of the invoice. The product concerned must be returned at the same time as the exercise of the right of withdrawal and sent by post to IVARENE, 68 rue Singer, 75016, Paris, France (postmark serving as proof). Return costs are the responsibility of the customer. The company will process the refund of the payment received for the product subject to the withdrawal within 14 working days from the moment it is informed of the customer's decision to exercise their right of withdrawal. The refund period may be deferred until receipt and verification of the returned product. However, please note that refunds for jewellery can only be processed if all of the following conditions are met:

• The product must not have been worn, used, altered, damaged, or subjected to any handling that would prevent its resale as new.
• The product must not have been made to order.
• The product must be returned in its original packaging along with the purchase invoice.

DELIVERY

The seller ships from Paris, France, and delivers to France and most countries worldwide. Orders are shipped to the address stated on the electronic invoice issued upon order confirmation, based on the information provided by the customer, within the timeframe indicated on the order confirmation page. Delivery times, which only begin from the day the order is validated and paid for, are given as an indication only, and any failure to meet them shall not give rise to any deduction, compensation, or damages, nor justify the cancellation of pending orders. Deliveries are made subject to stock availability and supply lead times, and subject to any technical difficulties. The seller cannot be held responsible for delivery delays related to its suppliers, nor liable for penalties or damages of any kind due to a delay or non-delivery resulting from force majeure or unforeseen circumstances. Force majeure includes any circumstances beyond the seller's control that result in a stoppage or reduction in production or delivery by its own suppliers. In the event of force majeure, the seller's obligations are suspended without any formality, and the seller is released from all liability.

As a general indication, if your order is placed Monday to Friday before 12pm, it will generally be shipped within 24 to 48 hours after payment confirmation. Any order placed on Friday from 1pm, on Saturday, or on Sunday cannot be dispatched before the following Monday (excluding public holidays). In the event of a longer delay, an email will be sent to the customer to inform them of any potential impact on the previously indicated delivery timeframe. Transport risks are borne by the customer, who must file a reasoned complaint with the postal services or carrier within three working days of delivery. Upon receipt of their order, the customer must check that the products received are as expected. Any anomaly regarding the delivery (missing or broken product, damaged parcel) must be reported on the day of receipt, or at the latest on the first working day following receipt, to customer service at hello@ivarenegems.com, failing which the seller cannot commit to refunding the order. Delivered products conform to the seller's offerings, subject to tolerances accepted by professional and manufacturing standards. The seller guarantees the products sold only under the conditions and limits of the legal guarantee of conformity set out in Articles L.217-1 and following of the Consumer Code, and the legal guarantee against hidden defects set out in Articles 1641 and following of the Civil Code.

RETURNS

You have 14 days from the receipt of your order to notify us of your wish to return it.

Returns are accepted only for orders placed from a country within the European Union.

To initiate a return, contact us at hello@ivarenegems.com with your order number and a photo of the item concerned.

For customers based in France, we will provide a prepaid shipping label. Return costs will be deducted from the refunded amount. For customers based outside of France, return costs and arrangements are your responsibility, to the following address: IVARENE, 68 rue Singer, 75016 Paris, France.

The jewellery must be returned in its original condition, unworn, in its original packaging, accompanied by your order number. Only returns insured for the value of the jewellery will be accepted.

If your original order qualified for free shipping and the return brings the total below the free shipping threshold, the initial shipping costs will also be deducted from the refunded amount.

Once your return has been received and approved, the refund will be issued to your original payment method within the usual banking timeframes.

APPLICABLE LAW

The law applicable to this contract is French law. The competent courts are the courts of Paris, France.
