1. Applicability and enforceability of the T&Cs
1.1. These terms and conditions of sale (T&Cs) define the terms governing the commercial relationship between IVARENE (the "Seller") and its professional clients (the "Client").
1.2. Any order placed with IVARENE implies full acceptance of these T&Cs.
1.3. IVARENE reserves the right to modify the T&Cs at any time. The applicable T&Cs are those in force at the date of the order.
2. Products
2.1. All IVARENE jewelry is handmade in Paris. Each piece is unique, and variations in color, transparency, or natural inclusions may appear. These characteristics are not considered defects.
2.2. Product images and descriptions on our materials are non-contractual and provided for information purposes only.
3. Orders
3.1. Minimum order amount: €2,000 excl. tax (excluding shipping and taxes).
3.2. Orders must be sent by email to: hello@ivarene.com.
3.3. An order is considered accepted only after written confirmation from IVARENE and payment of a 50% deposit.
3.4. Production lead time: between 2 and 6 weeks, depending on stone availability, purchase period, and ordered quantities.
3.5. Re-orders: minimum amount of €800 excl. tax.
4. Prices and payment
4.1. Prices
- Prices are quoted in euros excluding taxes (excl. VAT).
- Shipping, insurance, and any applicable taxes (customs duties, VAT, etc.) are borne by the Client.
- Prices are subject to change without notice. The applicable price is the one in effect at the date of the order.
4.2. Payment terms
- 50% deposit upon order.
- 50% before shipment.
- Payments are accepted by bank transfer only.
4.3. Late or non-payment
In case of total or partial non-payment by the due date, IVARENE reserves the right to suspend or cancel the order.
5. Delivery
5.1. Orders are shipped from Paris, France.
5.2. Shipping and insurance costs are borne by the Client.
5.3. Delivery times are indicative only. IVARENE cannot be held responsible for delays due to force majeure or third-party issues.
5.4. The Client must inspect the goods upon receipt and report any non-conformity or defect within three (3) business days by email to hello@ivarene.com.
6. Warranties and returns
6.1. Statutory warranties
- Legal warranty of conformity: covers non-conformities present upon delivery. In case of non-conformity, the Client may request repair, replacement, or refund.
- Warranty against hidden defects: covers defects that render the product unusable or significantly diminish its usefulness. The Client may request a price reduction or cancellation of the sale.
6.2. Exclusions
Artisanal variations (finishes, shades, natural stone imperfections) are not considered defects. Damage caused by mishandling or improper use is not covered.
6.3. Return process
- For any defective product, the Client must send a photo and purchase date, and fill in the after-sales form available on request at hello@ivarene.com.
- If the defect is confirmed, IVARENE will offer a repair, exchange, or refund if repair or exchange is not possible. Return costs are borne by the Client.
7. Sales restrictions
7.1. Resale via third-party platforms (Amazon, eBay, Etsy, etc.) is strictly prohibited.
7.2. Online sales of IVARENE jewelry are reserved for resellers with a written agreement and who meet a minimum annual purchase volume.
8. Liability and indemnification
8.1. IVARENE disclaims all liability for indirect losses, loss of profit, or consequential damages related to the use or sale of the products.
8.2. The Client indemnifies IVARENE against any third-party claims in connection with the resale of the products.
9. Confidentiality
9.1. Prices, sales conditions, and other information provided by IVARENE are strictly confidential. Any disclosure to a third party without prior written consent is prohibited.
10. Governing law and jurisdiction
10.1. These T&Cs are governed by French law.
10.2. Any dispute relating to their interpretation or execution shall be subject to the exclusive jurisdiction of the courts of Paris.
10.3. These T&Cs are available in French and English. In the event of any discrepancy between the two versions, the French version shall prevail.
